WAKE FOREST, N.C. -

A 21-year-old driver is facing DWI charges and death by motor vehicle charges after a passenger in his car died in an early morning accident in Wake Forest.

Matthew Lyle Achterman, 23, of Wake Forest was killed after the car he was riding in crashed with another vehicle on Ligon Mill Road near Greenville Loop.

According to the State Highway Patrol, a black 2008 Honda, driven by 21-year-old Christopher Philip May was travelling east on Ligon Mill Road shortly before 12:30 a.m. Saturday when it crossed the center lane and collided with a gray 2005 Honda heading in the opposite direction, causing the black Honda to overturn.

Highway Patrol says Achterman was not wearing his seatbelt at the time of the accident.

May, the driver, is charged with DWI and driving left of center. The charges will be upgraded to felony death by vehicle, Sgt. Howard Wilkerson with the Highway Patrol said. May's blood alcohol content was above the limit of .08, according to Wilkerson.

He and another passenger, 17-year-old Nelson Cody Arrington, were transported to WakeMed.

The driver of the other car, 44-year-old Bertha Ashton Thornton, was also transported to WakeMed.
