Fuquay-Varina Police have charged Daniel Jerome Montgomery with first-degree murder in connection the the double shooting outside a church.
He was arrested at the hospital and appeared before a Wake County Magistrate on Tuesday.
Jammie Street died during the confrontation with her boyfriend at St. Augusta Missionary Baptist Church on Bridge Street on Oct. 7.
Family and friends arrived quickly to the church after hearing the news 30-year-old Jammie Street had been shot and killed. Her aunt, Doris Burton, says the family is trying to make sense of what happened.
"We just don't understand why all of this took place," Burton said.
Family members say Street was dropping off two of her three children for a before-school daycare program to make it to her job on time as a Wake County Public School System bus driver. That's when police say there was a confrontation between her and 31-year-old Montgomery.
Police say Street died of at least one gunshot wound. Montgomery was also shot once in the chest and was taken to WakeMed hospital.
Across the street from the church, Larry Evans says he was standing in his front yard at the time of the shooting. He says he first heard a woman yell.
"Then I heard two shots, and then I heard another holler and then I heard another shot," Evans said.
Burton says the status of the relationship between her niece and Montgomery wasn't clear, but the family does know Montgomery is the father of her Street's youngest child.
"A young mother, full of life, loved her family, loved riding horses, an outdoor person, she just has so much to give and for her life to be taken the way it was taken ... senseless," Burton said. "We'll miss her, she'll be missed."
Burton says she wasn't aware of any recent problems between the two, but police records show a troubled history.
Police say Montgomery was arrested for domestic assault and domestic trespass in two separate incidents earlier this year involving Street.
He was also convicted of assault on a female in 2002 and given probation.
Fuquay-Varina Police Chief Larry Smith says it's hard to see it come to this.
"It is frustrating when you're there with a young mother and her children, and to see a senseless tragedy like this occur," Smith said. "It does shake up our community; it shakes up our police department."
Street worked as a bus driver for Wake County Public Schools since March 2000, according to a spokesman, who says she was a good employee and that they are shocked and saddened by her death.
Montgomery is being held without bond at the hospital. He will be transferred to a secure facility when he is release from the hospital.

To the "Anonymous" poster on 10/08, what do you mean by "(it) taking a murder before police issued a warrant for his arrest"?? The police had issued AND served several warrants for past criminal acts on his behalf. Furthermore, if you're referring to the fact that he committed murder and should be arrested, you cannot create and/or serve a warrant for murder unless the murder has been committed....get your facts straight moron.

I think this is oh so sad. After the incident with the different situations with the assault charges he should have been on some other type of restraint. This is sad and I feel so sad for the children, just another case of black kids coming up without there parents. I will pray for the family and the kids. Her sister is my cousin and I don't even know her. :(

This is a very sad situation. What is even worse is that it has taken this man to commit murder before the police department issued a warrant for his arrest. He should have been locked up after the 2nd charge of assult. What has our criminal justice system become?

I think this is very sad, I grew up with Montgomery, me and my brothers. I am not at all close to him or his family, the only thing that is not making that much sense in this situation is usually when a person is commiting a suicide attempt, they go for either the mouth the the temple... why would he shoot his own self in the chest?? I don't get it!! i just pray for the young mother's children and her family as well as Montgomery's, and ask that the truth (what ever it is) be revealed - Amen
